Asset Searches

Prior to Entering a Lawsuit

It is important to conduct an asset search prior to filing suit against an individual or company to determine what assets or regular income is present in the event a judgement is ordered by the court (see below). It is not worth the cost of legal fees to file a suit against a person or company that will be unable to pay any court ordered sum. It is also important to determine what assets or property could be attached on an uncontested basis once a judgement is issued, assuming victory in the suit. If the entity to be sued has nothing of value that can be taken, there is no point in entering a lawsuit.

Collecting on a Judgement

When the court orders a sum of money to be paid as part of a civil action, a judgement is issued, this is simply a court order for the payment of funds. It is rare for the defendant to simply pay the amount ordered on the spot. The judicial system only orders payment, but collection is the responsibility of the plaintiff. A judgement will stand for ten years, but can be extended to become permanent. However, this requires that the defendant, who is now considered to be the debtor, be questioned in a deposition or hearing under oath regarding their financial status. If the debtor is going to surrender an item of property such as an automobile or boat, be certain to do an asset search before taking possession. If there are any liens against the property, taking possession may also bring with it liability for the lien.

Divorce

The finances involved in a divorce can often become rather complicated. It is not uncommon for a spouse to hide assets that would be open to dispute. An asset search of the party being divorced is very important to be certain that all assets are accounted for.

Child Support/Alimony

Public child support enforcement agencies are ill-equipped to locate parents who evade their child support obligations. Quite often the errant parent will attempt to hide assets, thus pleading an inability to meet child support of alimony payments. In child support cases, once the parent is located, information regarding their wages or any hidden assets should be given to the proper child support enforcement agency that can then facilitate collection.

Background Checks

We have the best wide variety of background check services available on the market today. Some of the most reliable information will be provided in a comprehensive search. Results that are accurate and trustworthy. Our services offer a range of search options including people search and criminal background search. In addition to a person’s address and phone number, you can expect to discover even the most minor misdemeanor. Here are a few reasons to run a background check.

Hiring Employees

Pre-employment screening is one of the most common reasons for a background check. Employers need to know who they are hiring and they have a duty to their shareholders, stakeholders and co-workers to keep everyone as safe as possible. Finding out the truth about someone using a background check is quick, inexpensive and allows an employer or H.R. department to take the guess work out of hiring.

As part of Due diligence

When buying a business or even a part of a business, one should always conduct a complete and detailed background check of the person or people selling the business itself. Regarding our American corporate entities, a company is like a person, it has a background of its own. A due diligence background check may also be used in cases where an investment is being considered in some type of project or venture. The reasoning for this type of background check is a simple way to protect the investment and the investors.

For Litigation

Often, when litigation is commenced, an attorney will want as much ammunition as possible to try and attack his or her opponent. A background check can reveal all sorts of things about people that can be used to attack their credibility, truthfulness and to verify or refute the testimony that they provide. In criminal defense cases, many times a background check will be conducted on the accusers or witnesses to try and locate crimes of dishonesty to impeach their testimony. Knowing more about the people you are opposing is one of the most obvious reasons for a background check.

When children may be at risk

Whenever your children are involved, the reason for a background check are numerous and very apparent. People will conduct a background check of their children’s care givers, people they may be traveling with, people that live in the neighborhood who appear suspicious. An ex-spouse’s new romantic interest, etc. etc. A background check is an excellent way to get information that a parent may need to protect their child.

Before a relationship gets serious

Dating is one thing, marriage is another. As licensed private investigators, we are finding more and more people who are in a relationship and pondering marriage who want to conduct a background check of the soon to be spouse. This is another great use of the background check to protect yourself. We have many people in their thirties and above who want to be sure they know the person they are committing to. There is also a pattern that shows that the more financially well off you are, the more likely you are to conduct a background check. The reason being, it will help to protect our client from being taken advantage of by the other person. Unfortunately, particularly with long distance relationships, we do find people pretending to be something or even someone they are not.

When things go wrong

Lastly, we have many people who call us for a background check because something has gone wrong. Someone has done something bad and now they want to know all about this person who has taken advantage of them or their loved ones. This type of background check will fill in the total picture and many times ends up being provided to your attorney, family or to the police to assist them in fixing the situation
